What we collect, how we use it, and the choices you have when you use ListingSong.

1. Who we are and what this Policy covers

This Privacy Policy describes how ListingSong (“ListingSong,” “we,” “us,” or “our”) collects, uses, and shares information when you visit listingsong.com, create an account, or use our services to generate songs and videos for real estate listings (collectively, the “Service”). It is part of, and incorporated into, our Terms of Service.

By using the Service, you acknowledge this Policy and, to the extent permitted by applicable law, consent to the collection, use, and sharing of information as described here. This Policy does not cover third-party websites, platforms, or services we do not control — including social media platforms where you may share content — even if you reach them from the Service.

2. Information we collect

Information you provide. This includes your name, email address, phone number, brokerage or company details, agent profile information (such as a headshot, title, or contact details you want featured), property addresses and listing details you enter or edit, photos and other files you upload, customization choices, and the contents of your communications with us.

Information collected automatically. When you use the Service, we and our providers automatically collect device and usage information such as IP address, browser and device type, pages viewed, actions taken, referring pages, approximate location derived from IP address, and cookie or similar identifiers. See Section 7 for more on cookies and analytics.

Information from third parties. When you search for an address, we retrieve listing information (such as property details, photos, and status) from third-party real estate data providers and public sources. We also receive limited information from our payment processor (such as card brand, last four digits, and payment outcomes — see Section 5), from communications providers (such as message delivery status), and from platforms where our public reviews appear.

3. How we use information

We use information to:

  • provide and operate the Service, including generating songs, lyrics, and videos from the listing information and content you supply;
  • create and manage your account, authenticate logins (for example, one-time codes), and provide customer support;
  • process payments, credits, and auto-pay charges, and detect and prevent fraud, chargebacks, and abuse of promotions or previews;
  • send transactional and service communications, and — where you have opted in or where permitted by law — marketing communications;
  • analyze usage, monitor performance, debug, and improve the Service and develop new features;
  • showcase examples of our work, such as featuring completed songs and videos in our marketing (contact us to request exclusion of a specific piece);
  • comply with legal obligations and enforce our Terms and other rights; and
  • for any other purpose disclosed to you at the time of collection or with your consent.

4. How we share information

We do not sell your personal information, and we have not sold personal information in the preceding 12 months. We share information in the following circumstances:

  • Service providers. With vendors that perform services on our behalf — payment processing (Stripe), cloud hosting and storage, AI music, lyric, and video generation, real estate data lookup, email and SMS delivery, and product analytics. These providers are permitted to use the information only to provide services to us.
  • Content you publish. Songs and videos you generate are designed to be shared. Anything you (or we, at your direction) publish — including listing details and your agent branding — is visible to whoever can access it.
  • Legal and safety. When we believe disclosure is reasonably necessary to comply with a law, regulation, subpoena, or legal process; to enforce our Terms; to detect or prevent fraud or abuse; or to protect the rights, property, or safety of ListingSong, our users, or others.
  • Business transfers. In connection with a merger, acquisition, financing, reorganization, or sale of assets, in which case information may be transferred as a business asset.
  • With your direction or consent. For example, when you connect or share to a third-party platform.

We may also share aggregated or de-identified information that cannot reasonably be used to identify you, for any purpose.

5. Payment information

Payments are processed by our third-party payment processor (currently Stripe). Your full card number is transmitted directly to the processor and is not stored on our servers. Stripe retains the payment details needed to process the purchases you authorize. We retain billing identifiers, purchase history, access dates, and payment outcomes needed to operate your account. The processor’s handling of your information is governed by its own privacy policy, and we are not responsible for its practices.

6. Text messages

If you provide a phone number, we may send you transactional texts (such as login codes and order updates) and, if you opt in, marketing texts. Message frequency varies and message and data rates may apply. Reply STOP to opt out and HELP for help. Consent to marketing texts is not a condition of purchase. No mobile opt-in data or consent information is shared with third parties or affiliates for their own marketing or promotional purposes. Text messaging opt-in data is used only to deliver the messages you requested through our SMS delivery providers.

7. Cookies and analytics

We and our providers use cookies, local storage, and similar technologies to keep you signed in, remember your progress (such as a draft order), secure the Service, measure usage, and understand how features perform. We use product analytics tools that may collect device identifiers, usage events, and, where enabled, session interaction data to help us improve the Service.

Most browsers let you refuse or delete cookies through their settings. If you disable cookies, parts of the Service (including sign-in and checkout) may not work. We do not currently respond to “Do Not Track” browser signals, as no consistent industry standard exists.

8. AI processing

The Service generates content using artificial-intelligence systems, including third-party AI providers. Listing details, photos, names, pronunciations, and customization inputs you provide may be processed by those providers to produce your songs, lyrics, and videos. We may also use inputs, outputs, and related usage data to operate, evaluate, and improve the Service, including improving prompts, quality, and pipelines. Do not include sensitive personal information (such as government identifiers, health, or financial account details) in content you submit for generation — the Service does not need it and it may be embedded in generated media that is designed to be shared publicly.

9. Data retention

We retain information for as long as reasonably necessary to provide the Service, maintain your account and purchase history, deliver and host your generated content, comply with legal, tax, and accounting obligations, resolve disputes, prevent fraud and abuse, and enforce our agreements. Retention periods vary by data type and context, and we may retain backup or archival copies for a period after deletion. We may delete generated media, drafts, or unused previews at any time as part of routine storage management, and we are not obligated to store any content indefinitely — download and back up media you want to keep.

10. Security

We use administrative, technical, and organizational measures designed to protect information, appropriate to the nature of the data we handle. However, no method of transmission or storage is completely secure, and we cannot and do not guarantee the security of any information. You provide information at your own risk and are responsible for keeping your login access secure and for the security of the devices and accounts (including email and phone) you use to access the Service.

11. Your choices and rights

Communications. You can opt out of marketing emails via the unsubscribe link in each email and opt out of texts by replying STOP. We may still send transactional and account messages.

Account information. You can review and update certain information in your account, or contact us at support@listingsong.com to request access to, correction of, or deletion of personal information we hold about you.

State privacy rights. Depending on where you live, you may have rights under state privacy laws (such as the California Consumer Privacy Act) to know, access, correct, or delete personal information, and the right not to receive discriminatory treatment for exercising those rights. We do not sell personal information or use it for cross-context behavioral advertising as those terms are defined under applicable law. To exercise any right, email support@listingsong.com from the email associated with your account; we may need to verify your identity before acting, and we will honor rights as required by the law that applies to you. We may retain information as needed for the purposes described in Section 9 even after a deletion request, where permitted by law.

12. Children's privacy

The Service is a business tool intended for adults and is not directed to anyone under 18, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact us at support@listingsong.com and we will delete it as required by law.

13. United States processing

The Service is operated from the United States and is intended for users located in the United States. Information we collect is stored and processed in the United States (and in other locations where our service providers operate), where privacy laws may differ from those in your jurisdiction. If you access the Service from outside the United States, you do so at your own initiative and consent to your information being transferred to and processed in the United States.

14. Changes to this Policy

We may update this Privacy Policy at any time. When we do, we will post the updated Policy on this page and revise the “Last updated” date, and we may provide additional notice of material changes. Changes take effect when posted unless stated otherwise. Your continued use of the Service after changes take effect constitutes acceptance of the updated Policy.
